37 – Daniel’s Guilty Plea Closed One Door, but Thomas Vale’s Trial Opened a Question About Raymond No Recording Had Answered

By January, the house had settled back into winter.

Not the old version of normal.

There was no old version anymore.

There were new locks, new habits, a folder near the telephone with Samuel’s number, Detective Bennett’s number and instructions for handling unfamiliar legal notices.

There was also a stack of Meridian construction plans on my dining-room sideboard.

The service easement work would not begin until spring.

Survey flags appeared along the far northern edge of the property.

This time every flag had permission.

Every worker signed in.

Every map matched the agreement.

The difference felt enormous.

Daniel Dalton entered his guilty plea on a Tuesday morning.

I attended because I wanted to hear the words myself.

Mark came too.

Peter Cole sat two rows behind us.

Caroline joined by video from Arizona for a separate proceeding later, but she had sent Peter a note.

Samuel sat beside me.

Daniel looked thinner.

Older.

His recovery from the Fairhaven shooting had left him with a slight stiffness when he walked.

For once, I felt no satisfaction seeing weakness.

Physical weakness had never been the problem.

The judge reviewed every count carefully.

Daniel acknowledged participating in schemes involving fraudulent property acquisition, false documentation, misuse of confidential client information, obstruction and concealment related to multiple elderly property owners.

He also admitted that after Margaret Cole’s fall, he failed to report the true circumstances and helped preserve a false narrative based on fabricated cognitive decline.

The prosecutor stated clearly that the evidence did not establish beyond the current record that Daniel intentionally pushed Margaret down the stairs.

He admitted grabbing her during the argument.

She pulled away.

Lost balance.

Fell backward.

He panicked.

Then he lied.

Vale helped.

Foster’s false letter and facility records gave them a ready-made explanation.

Confused elderly woman.

Accidental wandering.

Tragic fall.

The lie worked because paperwork had prepared everyone to believe it.

Peter bowed his head when Daniel described calling him afterward.

Daniel admitted telling Peter that speaking publicly could expose Peter’s own role in pressuring his mother.

He admitted accepting payments from Peter for years under the guise of legal risk management.

Blackmail without using the word blackmail.

The judge did.

Daniel did not argue.

Then the prosecutor asked about my case.

Daniel admitted opening Raymond’s archived estate materials without proper purpose.

Profiling my finances and family relationships.

Using Gerald Pike’s unauthorized disclosures.

Working with Bruce and Alicia after the property opportunity emerged.

Developing the family-pressure strategy.

Preparing a capacity route if voluntary control failed.

Authorizing draft guardianship materials.

Using Marianne’s identity in documents after her death.

Supporting the plan to place me in Silver Meadows and sell my property through Lakeview below development value.

Each admission sounded flatter than the experience had felt.

Courtroom language does that.

It turns terror into verbs.

Obtain.

Conceal.

Transfer.

Misrepresent.

The judge asked Daniel whether anyone forced him to participate.

“No.”

“Did Thomas Vale force you?”

Daniel hesitated.

“No.”

“Did financial pressure force you?”

“No.”

“Did Alicia Hayes force you?”

“No.”

“Then why did you continue?”

Daniel looked toward the defense table.

“Because it worked.”

The courtroom went still.

That answer sounded more honest than anything else he could have offered.

Because it worked.

Older owners were pressured.

Families cooperated.

Professionals looked away.

Documents appeared legitimate.

Money moved.

Complaints died.

People felt too ashamed to speak later.

Why stop?

The system rewarded continuation.

The judge accepted the plea in principle pending sentencing and related matters.

Daniel would testify where required.

Including against Thomas Vale.

That trial was coming.

Vale had abandoned cooperation and chosen to fight.

His attorneys argued Daniel was the central criminal actor and Vale was an older lawyer who had made unethical decisions while trying to manage a reckless former associate.

I read that description in a motion.

Manage.

Again, language cleaning itself.

Peter caught me outside the courtroom.

“Can I ask you something?”

“Yes.”

“Did hearing Daniel admit it help?”

I thought.

“Help what?”

He nodded.

“That answers it.”

“No. Tell me what you mean.”

“I keep thinking if someone finally says the exact right words, I'll feel different about Mom.”

“Do you?”

“No.”

Neither did I.

Truth did not rewind.

It stopped distortion from continuing.

That was enough some days.

Peter had joined Margaret’s civil case challenge.

Lawyers believed portions of the old property transaction could be unwound or compensated.

But his real burden was not acreage.

“I told him where she was,” Peter said.

“Daniel?”

“Yes.”

“I know.”

“If I hadn't—”

I stopped him.

“No.”

He looked at me.

“You don't get to finish that sentence forever.”

“Why not?”

“Because it has no end.”

He swallowed.

“If I hadn't called, maybe he doesn't go. If you had listened to Marianne, maybe your mother sues earlier. If Caroline had spoken. If Foster had confessed. If Raymond had gone straight to police. If Samuel had found the papers. If the camera worked.”

Peter looked down.

“You forgot if I hadn't pressured her.”

“No. That belongs.”

He looked at me.

“Some ifs are responsibility. Some are fantasy.”

“How do you know which?”

“You ask whether the thing was actually your choice.”

He absorbed that.

“Calling Daniel was.”

“Yes.”

“Her falling wasn't.”

“Yes.”

He nodded slowly.

That distinction would not heal him.

But perhaps it would keep guilt from swallowing everything else.

Two weeks later, Vale’s pretrial hearings began.

His lawyers challenged evidence from Agnes’s ledger.

Marianne’s affidavit.

Daniel’s archive.

Gerald’s disclosures.

The Fairhaven recovery.

Some challenges failed.

Some remained.

One succeeded partly.

Certain privileged communications from Vale’s historical legal files could not be used as broadly as prosecutors wanted.

That angered people.

Including me.

Samuel explained why the ruling mattered.

“If rights disappear for people we dislike, they aren't rights.”

“I know.”

“Your face says otherwise.”

“My face is allowed opinions.”

He laughed.

The prosecution still had substantial independent evidence.

Financial records.

Nonprivileged emails.

Agnes recordings.

Marianne’s documents created outside attorney-client relationships.

Marlene’s testimony.

Gerald.

Ruth.

Grace.

Daniel.

Bruce.

And the recording after Margaret’s fall.

Vale's position narrowed.

He could not deny knowing.

So his defense changed.

He argued knowledge of wrongdoing did not equal authorship of every crime.

That was true.

He argued Daniel often ignored his instructions.

Also true.

He argued some of Agnes’s old practices predated him.

True again.

The trial would not be simple.

That bothered people who wanted one clean villain.

I had stopped wanting that.

Then came the question about Raymond.

Vale’s attorney filed notice that he intended to introduce evidence concerning Raymond’s long history of land disputes to challenge the idea that Vale targeted innocent owners solely for profit.

They wanted to portray Raymond as aggressive, suspicious and financially interested.

Samuel was furious.

I was less surprised.

“If evidence is true, let them use it.”

“Dorothy.”

“What?”

“They are going to make Raymond look difficult.”

“He was difficult.”

“They'll say he harassed county employees.”

“He probably did.”

“They'll say he moved fences.”

“He did.”

“They'll say he profited from land deals.”

“He did.”

Samuel stared.

“You aren't worried?”

“Yes.”

“About what?”

“Lies.”

Truth I could handle.

Raymond had not been a saint.

Agnes had told me not to make him one.

If Vale's defense needed Raymond perfect in order to lose, then the case was weak.

It was not.

A week before trial, prosecutors asked whether I would testify about Raymond’s habits.

My marriage.

His property decisions.

His secrecy.

Whether he told me about the Mercer boundary dispute.

I agreed.

Mark worried.

“What if they try to make Dad look bad?”

“They will.”

“You're okay with that?”

“No.”

“But you'll testify.”

“Yes.”

He looked toward Raymond’s photograph.

“I don't think I could.”

“You aren't being asked.”

“What would you say if they ask whether he kept things from you?”

“The truth.”

“That he did.”

“Yes.”

“Won't that help Vale?”

“Maybe.”

Mark looked troubled.

I continued.

“The point of court is not to help my side with every sentence.”

He almost smiled.

“You sound like Bennett.”

“That is offensive.”

The trial began in February.

The courtroom was fuller than Daniel’s plea hearing.

Reporters.

Former clients.

Families.

Attorneys.

People who wanted to see Thomas Vale exposed.

People who probably hoped he would be vindicated.

I did not know them.

Vale wore a dark suit.

No visible injury remained from Fairhaven except occasional stiffness in his shoulder.

He glanced at me once.

No expression.

The prosecutor’s opening focused on pattern.

Not a single transaction.

A long system of confidential information, vulnerable property owners, family leverage, misleading capacity narratives and financial benefit.

Vale’s defense focused on distance.

Daniel committed fraud.

Bruce committed fraud.

Lisa committed fraud.

Alicia acted for money.

Gerald leaked information.

Foster signed false letters.

Vale, they argued, gave legal advice inside a network he did not fully control.

The prosecution’s burden would be proving which lines he knowingly crossed.

Not simply that bad people knew him.

Important distinction.

Marlene Givens testified first among the witnesses I knew.

She admitted accepting gifts.

Processing documents without proper verification.

Accelerating Vale’s filings.

Her voice trembled.

Vale’s attorney asked whether Vale ever told her to forge a signature.

“No.”

“Alter a deed?”

“No.”

“Destroy a record?”

“No.”

That helped him.

Then prosecutor asked:

“Did Mr. Vale ever ask you to ensure certain notices were processed without ordinary delay?”

“Yes.”

“Did you question signatures?”

“Sometimes.”

“What did he tell you?”

“That lawyers were responsible for client verification.”

“And you relied on that?”

“Yes.”

“Even when the lawyer represented no owner?”

Marlene went quiet.

There.

The structure.

Everyone delegated doubt to someone else.

Gerald testified next.

He looked at me once and immediately looked away.

He admitted providing confidential information.

Vale’s attorney emphasized Gerald received money and chose to violate duties.

Vale did not force him.

True.

Then prosecutor displayed the email:

Need widow profile after probate. Especially decision habits.

Vale’s words.

Gerald’s reply:

She is capable but defers on technical matters. Son is influence point.

The courtroom became quiet.

The prosecutor asked Gerald:

“What did you understand Mr. Vale wanted?”

“Information about Dorothy.”

“For what?”

“Potential property strategy.”

“Did you know Mrs. Hayes had consented?”

“No.”

“Did you ask?”

“No.”

“Why?”

Gerald swallowed.

“Because I was being paid not to ask difficult questions.”

That sentence hurt.

Maybe because it described half the system.

People paid not to ask.

People helped because family asked.

People deferred because lawyers said routine.

Every missing question became space for fraud.

Then Marianne’s affidavit was introduced through proper foundation.

Her words filled the courtroom after years hidden.

She described Daniel.

Vale.

Agnes.

Her own early participation.

Her later fear.

Her attempts to report.

Vale’s attorney attacked her credibility.

She was dead.

Could not be cross-examined.

That issue had been argued extensively.

Only certain portions came in for certain purposes.

The process frustrated me.

But again, rights.

Then came Agnes’s recordings.

Vale’s own voice.

He could not call them hearsay in the ordinary way where his statements were admissions.

One recording captured him telling Daniel after Margaret’s fall:

Use the record you've already built.

That line mattered.

It linked Vale directly to the false cognitive narrative.

Defense argued he was responding to an emergency and trying to understand legal exposure.

Prosecution argued he was telling Daniel to exploit falsified records to conceal what happened.

Jurors would decide.

Then Peter testified.

Caroline.

Foster by recorded deposition because of health.

Bruce.

Lisa.

Each carried guilt.

Each gave defense lawyers openings.

Peter pressured Margaret.

Caroline stayed silent.

Foster signed false letters.

Bruce knowingly pursued profit.

Lisa committed crimes.

The defense used every flaw.

As they should.

But a pattern survived.

Different witnesses.

Different years.

Same names.

Same methods.

Same companies.

Same phrases.

By the time I was called, I no longer felt like the center of the case.

That was good.

I took the oath.

Sat.

The prosecutor began with Raymond.

“Mrs. Hayes, was your husband an easy man?”

I almost laughed.

“No.”

Several jurors smiled.

“Did he ever conceal financial or property matters from you?”

“Yes.”

“Why?”

“He thought handling problems for me was part of loving me.”

“Did you agree?”

“Not anymore.”

Vale’s attorney looked up.

The prosecutor continued.

“Was Raymond capable of conflict?”

“Yes.”

“Did he argue with neighbors?”

“Yes.”

“County officials?”

“Yes.”

“Attorneys?”

I looked at Vale.

“Apparently.”

A few people laughed.

Judge silenced them.

“Did he sometimes act without consulting you?”

“Yes.”

“Did he profit from property transactions?”

“Yes.”

“Did he accept twenty-five thousand dollars from a Vale company?”

“Yes.”

No attempt to hide it.

Then prosecutor walked through the context.

Consulting work.

Invoice.

Taxes.

Donation to legal fund.

Raymond’s email to Vale.

All documented.

“Did your husband ever tell you Thomas Vale bribed him?”

“No.”

“Did you find evidence he did?”

“No.”

“Did you discover evidence Mr. Vale tried to influence him?”

“Yes.”

Objection.

Foundation.

Sustained until documents established.

Court moved slowly.

Truth had rules.

When Vale’s lawyer cross-examined, he began with marriage.

“Mrs. Hayes, your husband kept important matters from you.”

“Yes.”

“So you cannot know everything he did.”

“Correct.”

Good question.

“Could he have made agreements with Mr. Vale you never learned about?”

“Possible.”

“Could he have accepted money without telling you?”

“He did.”

“Could he have acted for personal financial gain?”

“Yes.”

Samuel shifted behind counsel table.

I stayed still.

Vale’s lawyer seemed surprised by my cooperation.

He continued.

“Then isn't it possible Raymond Hayes was not the altruistic whistleblower prosecutors suggest?”

“Yes.”

The room went quiet.

The lawyer looked pleased.

Then I added:

“He could have had selfish motives too.”

The attorney frowned.

I continued only when permitted.

“People usually do.”

Judge allowed it.

Vale’s attorney asked, “But you loved him.”

“Yes.”

“You want to protect his reputation.”

“Yes.”

“So your testimony may be biased.”

“Yes.”

Another surprise.

Then:

“Mrs. Hayes, isn't it true that much of your understanding of Thomas Vale comes from records found after your husband's death?”

“Yes.”

“And from people charged with crimes?”

“Some.”

“And from a deceased woman who could not be questioned?”

“Some.”

“So you cannot personally testify that Mr. Vale ever ordered anyone to defraud you.”

“No.”

Correct.

That was important.

Vale deserved judgment based on his actions, not my anger.

Then the attorney made his mistake.

He asked:

“Would you agree your husband’s secrecy contributed to your vulnerability after his death?”

I looked at him.

“Yes.”

He paused.

That was not the answer he expected to help.

“How?”

“He knew people were studying our property and family. He wanted to protect me, so he handled it himself.”

“And that left you uninformed.”

“Yes.”

“So some responsibility for your later situation lies with Raymond.”

Prosecutor objected.

Argumentative.

Before the judge ruled, I felt anger rise.

Not because Raymond was perfect.

Because the lawyer was shifting agency.

The judge sustained.

Question withdrawn.

But the thought remained.

After court adjourned, Mark found me outside.

“You okay?”

“Yes.”

“You let him say awful things about Dad.”

“No.”

“What?”

“He asked questions.”

“You agreed Dad made you vulnerable.”

“He did.”

Mark stared.

“That doesn't mean Daniel and Vale get less responsibility for exploiting it.”

He understood slowly.

“Different layers.”

“Yes.”

If Raymond’s secrecy created vulnerability, that was our marriage’s truth.

If criminals exploited it, that was theirs.

One did not purchase the other’s innocence.

That night, while I was home, Bennett called.

Not about court.

About Gerald Pike.

He had remembered a meeting.

Late in Raymond’s illness.

Gerald visited our house to collect tax documents.

Raymond confronted him.

Directly.

Asked whether Vale was paying him for information.

Gerald lied.

Said no.

Raymond then told him something Gerald had never repeated.

“What?”

Bennett read from his supplemental statement.

Raymond said:

If I die before I prove this, Dorothy will finish it once she knows enough.

My throat tightened.

“When?”

“Three weeks before he died.”

I looked at his photograph.

He had believed eventually I would know.

He just never found the courage or time to be the one who told me.

That hurt.

It also gave me something unexpected.

He had trusted me.

Late.

Imperfectly.

Silently.

But he knew.

I went to the blue binder.

Found the page he had labeled:

HOUSE / BANK / TAX.

Ran my fingers over the cracked vinyl.

For years I thought it was simply organization.

Now it felt like an unfinished conversation.

PART 37 continued…

The next trial day, Daniel testified.

That was when Thomas Vale finally lost the advantage of distance.

Daniel described their first meeting.

Vale mentoring him.

Introducing him to Agnes's records.

Teaching him that families were easier points of entry than owners.

Vale’s attorney attacked him brutally.

Liar.

Fraudster.

Blackmailer.

Man seeking reduced sentence.

All true or potentially relevant.

Daniel agreed.

Then prosecutor asked:

“Why should anyone believe you?”

Daniel answered:

“They shouldn't without documents.”

That was probably the smartest thing he ever said.

Then the documents came.

Emails.

Payments.

Calendars.

Company formations.

Recordings.

Daniel’s testimony alone could be dismissed.

Daniel plus records became harder.

He described my case.

Vale initially warning him away because of Raymond.

Daniel proceeding anyway.

Vale later entering to contain exposure.

“Did Mr. Vale tell you to create Dorothy Hayes’s false medical narrative?”

“No.”

“Did he know it existed?”

“Yes.”

“How?”

“I sent him documents.”

“What did he say?”

“Too messy.”

“Did he report it?”

“No.”

“Did he help stop it?”

“No.”

“What did he do?”

“Structured liability.”

That distinction mattered.

Vale may not have conceived my false dementia record.

But he knowingly helped a fraudulent deal continue after learning it existed.

If jurors believed Daniel and records.

Vale’s defense showed emails where he told Daniel:

Do not use capacity route.

Also true.

Then another:

If already created, keep outside acquisition entity.

Ugly.

He objected to the method but helped conceal it.

The case lived in contradictions.

After Daniel finished, court recessed.

Samuel asked what I thought.

“That Vale is probably going to say he was cleaning up Daniel’s mess.”

“Yes.”

“And prosecution will say cleanup became participation.”

“Yes.”

“And both may be partly true.”

Samuel smiled tiredly.

“You would have made a difficult juror.”

“Why?”

“You refuse simple stories.”

“I've had practice.”

At home that evening, another letter waited.

Not anonymous.

From Alicia.

I carried it inside.

Did not open it.

Not yet.

There were only eight parts left in the story of what happened to me.

But real life did not know parts.

It simply continued.

And before I could decide what forgiveness meant, I still needed to decide whether I wanted to hear Alicia’s version when she no longer had anything left to gain from telling it.

Click here to continue reading: PART 38: Alicia’s Letter Asked for Nothing From Me, and That Made It Harder to
